These Terms of Service govern your use of Peakframe Media’s website and services. By purchasing or using services from Peakframe Media, you agree to these Terms.

Services

Peakframe Media provides digital marketing services, including Google Ads management.

The $49 Google Ads Management plan includes management of one Google Search campaign for one business. Services may include keyword research and management, search-term optimization, negative keyword management, ad copy optimization, bid and budget monitoring, basic conversion tracking when reasonably supported by the client’s website, and monthly performance reporting.

Services outside this scope—including additional campaigns, e-commerce advertising, extensive landing page development, advanced tracking, creative production, or broader digital marketing strategy—may require a separate agreement and additional fees.

Setup

If you do not already have an eligible Google Search campaign, Peakframe Media will set up the initial campaign included with the $49 plan at no additional setup fee.

Additional campaigns or work outside the scope of the plan are not included.

Monthly Subscription

The $49 Google Ads Management plan costs $49 per month and is billed on a recurring monthly basis until canceled.

There is no long-term commitment. You may cancel your subscription at any time. Cancellation prevents future subscription renewals but does not automatically refund fees already charged for the current billing period.

Advertising Spend

The $49 monthly fee covers Peakframe Media’s management services only.

Google Ads advertising spend is not included.

You are responsible for establishing and funding your advertising budget directly through your Google Ads account. Advertising charges from Google are separate from fees paid to Peakframe Media.

Google Ads Account Ownership

You retain ownership of your Google Ads account, campaign data, advertising data, and billing relationship with Google.

Peakframe Media may be granted manager or administrative access necessary to provide the purchased services. You should never provide Peakframe Media with your Google account password.

Client Responsibilities

You agree to provide accurate information and reasonable access to the accounts, website, analytics, tracking systems, and other resources necessary for Peakframe Media to perform the services.

You are responsible for the accuracy and legality of information concerning your business, products, services, claims, pricing, licenses, offers, and other materials supplied to Peakframe Media.

Delays in providing required information or account access may delay campaign setup or management.

Campaign Approval and Platform Policies

Advertising campaigns are subject to Google's policies, review processes, account requirements, and platform decisions.

Peakframe Media cannot guarantee that Google will approve any advertisement, keyword, website, account, or campaign. Google may restrict, suspend, reject, or modify advertising eligibility independently of Peakframe Media.

No Guarantee of Results

Peakframe Media does not guarantee a specific number of leads, calls, sales, conversions, impressions, clicks, revenue, return on advertising spend, or other business results.

Advertising performance can be affected by factors outside Peakframe Media's control, including competition, market demand, advertising budget, geographic location, website performance, pricing, business reputation, offer quality, sales processes, seasonality, and changes made by advertising platforms.

Peakframe Media agrees to provide professional campaign management and optimization but does not guarantee particular advertising or business outcomes.

Third-Party Platforms

Our services may depend on third-party platforms and providers, including Google, Squarespace, analytics providers, payment processors, and other technology services.

Peakframe Media is not responsible for outages, policy changes, account suspensions, pricing changes, technical failures, platform errors, or other actions taken by third-party providers outside our reasonable control.

Payments

You authorize the applicable payment processor to charge the payment method provided for recurring subscription fees.

If payment cannot be processed, Peakframe Media may pause or discontinue services until the account is brought current.

Cancellation and Refunds

Subscriptions may be canceled at any time.

Unless otherwise required by applicable law or expressly stated in our Refund & Cancellation Policy, payments already processed are generally non-refundable because they cover access to and performance of professional services during the applicable billing period.

Intellectual Property

Peakframe Media retains ownership of its proprietary processes, methodologies, templates, systems, strategies, branding, and other intellectual property.

Clients retain ownership of their business materials and advertising accounts. Upon payment for services, clients may continue using advertising copy and campaign materials created specifically for their business, subject to any applicable third-party rights.

Limitation of Liability

To the fullest extent permitted by applicable law, Peakframe Media will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of our website or services, including lost profits, lost revenue, lost business opportunities, or loss of data.

To the fullest extent permitted by applicable law, Peakframe Media's aggregate liability arising from a particular paid service will not exceed the amount paid to Peakframe Media for that service during the three months immediately preceding the event giving rise to the claim.

Indemnification

You agree to indemnify and hold Peakframe Media harmless from claims, damages, liabilities, or expenses arising from materials, representations, products, services, instructions, or information you provide to us, or from your violation of applicable law or third-party rights.

Termination of Services

Peakframe Media reserves the right to suspend or terminate services for nonpayment, unlawful activity, abusive conduct, misuse of services, violation of advertising platform policies, or material violation of these Terms.

Changes to These Terms

Peakframe Media may update these Terms periodically. Updated Terms will be posted on this page with a revised “Last Updated” date.

Continued use of our services after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.

Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law principles.
